Legal Issues

Adoptexas does not practice law, however, is represented by an attorney; and a member of the American Academy of Adoption Attorneys. Adoptexas will provide you with all the requisite documents pertaining to the placement of a child with adoptive parents.

These documents will be provided to you for your review prior to signing and they are as follows:

Irrevocable Affidavit of Relinquishment of Parental Rights - This affidavit is signed 48 hours after the baby's birth by the birth mother. The birth father signs this document only if he and the birth mother are married or his paternity has been established.
Affidavit of Status - This affidavit is signed by the birth mother and gives the name and address of the probable father and confirms marital status.
Affidavit of Waiver of Interest - This waiver is signed by the biological father if he is not married to the birth mother. (This Affidavit may be signed before or after the birth of the baby).
Release of Medical Information - This release is signed by the birth mother.
Birth Certificate Application - This application document is signed in the hospital after the birth of the baby. Do not let anyone else fill out or sign this application but yourself. We will discuss the reasons for this during counseling. The birth mother has the right to name the baby and that name will always be on the original birth certificate or she can put the first and middle names that the adoptive family has chosen along with her last name on the birth certificate. The adoptive family will then apply for a second birth certificate that will have the name they have chosen along with their last name. They will apply for this at the date of the consummation of the adoption.
Hospital Release of Infant - This release allows the baby to leave the hospital with the appropriate party ie. the adoptive family or a representative of Adoptexas.
Permission For Medical Care - This document is signed by the birth mother and gives permission for the adoptive family to get medical care for the baby.
